What Is the EB5 Visa Program?

In general, the USCIS offers EB5 visas to foreign nationals so they may seek permanent residency for themselves, their spouses, and any unmarried children under 21 years of age when they invest in the U.S. economy.

This can be done by any of the following:

  • INVESTING $1 MILLION INTO A QUALIFIED COMMERCIAL PROJECT THAT WILL CREATE AT LEAST TEN NEW JOBS
  • INVESTING $500,000 INTO “TARGETED EMPLOYMENT AREAS” (TEA)
  • INVESTING $500,000 IN AN APPROVED REGIONAL CENTER THAT CREATES TEN JOBS WITHIN TWO YEARS
History of the EB5 Program

EB5 visas are based on the Immigration Act of 1990 (“IMMACT 90”) which named the investor program as the fifth preference category for employment-based immigration. This visa category is the only one that can help investors become permanent legal residents if they invest in U.S. businesses.

How Many Visas Are Available Annually?

There are approximately 10,000 EB5 visas available to investors per year. The USCIS also allows 3,000 visas for those who invest in TEAs and an additional 3,000 visas for investments in Regional Centers.

The Immigrant Investor Pilot Program is thus in place to help projects that would otherwise find it difficult to obtain funding which are benefitted by:

  • Stimulated job expansion
  • Improved regional productivity
  • Expanded or improved infrastructure
  • Promoted growth of new businesses

Though the program is temporary, its popularity has risen over the years and approval of applications is generally high. Conditional green cards given to investors and their immediate family member are good for two years, after which the investor may petition for permanent residency.

How Do I Qualify?

An investor may qualify for an EB5 visa via indirect or direct investment. This means that the investor is not required to live where the investment is made nor do they have to be responsible for the business’ daily operation or management.
